Safe stair negotiation is an everyday task that children with developmental coordination disorder are commonly thought to struggle with. Yet, there is currently a paucity of research supporting these claims. We investigated the visuomotor control strategies underpinning stair negotiation in children with and without DCD by measuring kinematics, gaze behavior and state anxiety as they ascended and descended a staircase. A questionnaire was administered to determine parents' confidence in their child's ability to safely navigate stairs and their child's fall history. (...) Kinematics were measured using three-dimensional motion capture, whilst gaze was measured using mobile eye-tracking equipment. The parents of DCD children reported significantly lower confidence in their child's ability to maintain balance on the stairs and significantly more stair-related falls in the previous year compared to the parents of typically developing children. During both stair ascent and stair descent, the children with DCD took longer to ascend/descend the staircase and displayed greater handrail use, reflecting a more cautious stair negotiation strategy. No differences were observed between groups in their margin of stability, but the DCD children exhibited significantly greater variability in their foot-clearances over the step edge, which may increase the risk of a fall. For stair descent only, the DCD children reported significantly higher levels of state anxiety than the TD children and looked significantly further along the staircase during the initial entry phase, suggesting an anxiety-related response that may bias gaze toward the planning of future stepping actions over the accurate execution of an ongoing step. Taken together, our findings provide the first quantifiable evidence that safe stair negotiation is a significant challenge for children with DCD, and that this challenge is reflected by marked differences in their visuomotor control strategies and state anxiety levels. Whilst it is currently unclear whether these differences are contributing to the frequency of stair-related falls in children with DCD, our findings pave the way for future research to answer these important questions. We give anecdotal accounts from our own experience of scientific theories which have been generally accepted as the ruling opinion long after sufficient evidence has been collected for their disproof. This has led us to the opinion that the normal scientific process, of working hypothesis followed by experimental test aimed at disproof, is being replaced by the ruling opinion followed by experiment aimed at confirmation. The apparently widespread adoption of this procedure may be postulated to arise in part from the (...) need for workers entering a new field of study to obtain grants and to get their results published. The Diagnosis Confirmation Model includes a dual-pricing mechanism designed to support value-based pricing of novel antibiotics while improving the alignment of financial incentives with their optimal use in patients at high risk of drug-resistant infections. DCM is a market-based model and complementary to delinked models. Policymakers interested in stimulating antibiotic innovation could consider tailoring the DCM to their reimbursement systems and incorporating it into the suite of incentives to improve the economics of antibiotics.

In this article, the author argues that beliefs about vulnerability and dangerousness are central to conceptions of gender and are constructed and transmitted through conversation. Using data from 13 focus groups, the author demonstrates that ideas about gender and its relationship to vulnerability and danger are pervasive in talk about violence, and that this talk is further marked by ideas about age, race, social class, and sexual identity. These ideas are based, in part, on shared beliefs about human bodies, which (...) reinforce the perceived naturalness of these ideas. A central characteristic of people with Prader-Willi Syndrome (PWS) is an apparent insatiable appetite leading to severe overeating and the potential for marked obesity and associated serious health problems and premature death. This behaviour may be due to the effects of the genetic defect resulting from the chromosome 15 abnormalities associated with the syndrome. We examine the ethical and legal dilemmas that can arise in the care of people with PWS. A tension exists between a genetic deterministic perspective and that (...) of individual choice. We conclude that the determination of the capacity of a person with PWS to make decisions about his/her eating behaviour and to control that behaviour is of particular importance in resolving this dilemma. If the person is found to lack capacity, the common law principles of acting in a person's "best interests" using the "least restrictive alternative" may be helpful. Allowing serious weight gain in the absence of careful consideration of these issues is an abdication of responsibility. (shrink)

Holland I FIRST, A CONFESSION. Like, I suspect, many of my readers, I am an unpublished fiction writer. Unlike most of the closet fiction writers in academia, however, I write genre fiction. The question that immediately follows is how that writing is related to (...) the intellectual work I do in philosophy.This question, of course, is open to a broad range of answers, from the possibility that the two aren't related at all, to potential Freudian answers it might take years of therapy to unearth. Teaching informs one's life, however, as much as the reverse, and in teaching Martin Heidegger's "The Origin of the Work of Art" to my Metaphysics class last year, I began to understand at least one dimension of the appeal that writing genre fiction has for me as a philosopher.But first, let me explain what I mean by genre fiction. In what follows, I will be referring primarily to four forms of genre fiction that have clear roots in the nineteenth century in Western Europe and North America: two gender-segregated genres, the western and the romance, and two gender-marked genres, science fiction and detective novels. I will be comparing these to two other forms of "popular culture" that also developed in the nineteenth century and have, I would argue, similar relationships to the older, more "legitimate," more elite art forms which they closely resemble: photography 1 and popular music, [End Page 216] especially those forms of popular music such as ragtime, blues, jazz, and rock that are informed by the African-American experience in the United States. 2These "low brow" art forms all appear to have arisen out of the growth of the middle class in developing parts of the world during the nineteenth century and the correlative confluence of greater leisure, greater aggregate prosperity, and higher levels of education across a broader spectrum of society. Further, these art forms all combine the surface appearance of their respective "high brow" correlate arts with the reassurance of repetition that is the cornerstone of the folk arts with which they are also correlated. Each of these forms of popular culture balances itself, then, between a demand for more and more "works of art" (and/or class aspirations based on the appearance of such) and a demand for the familiar in a rapidly changing, materially challenging world.Thus, photography gives us a frozen and thereby purified visual reality, an icon of memory to which we can return at will. The truth it reveals is most often starker than that of folk painting and portraiture, but also gives the appearance of being free from the subjectivity of the artist. Great iconic photographs such as the kiss on V-E day, I have heard it said, become more real than the reality they encapsulated.Popular music similarly combines often amazing musical complexity (which is not unknown, although rarer, in western folk music) with the reassurance of a form that not only repeats itself within a song, but also between songs of the same genre. Thus, blues can be recognized by both the minor chords in its melodies and the characteristic rhyme pattern of its lyrics. Moreover, most western popular music, even to some extent free-form jazz, has a familiar and reassuring beginning-middle-end structure, both melodically and dynamically, that locates a listener immediately within the song's "story-arc." 3This same beginning-middle-end structure is one clear hallmark of genre fiction. Speaking freely is considered an essential component of academic freedom and freedom of inquiry. Unfortunately, historically as well as currently, the right to speak freely has often resulted in polemics and disputes between scholars. But the entire purpose of frankness in speech, whether in the academic or the political realm, is to persuade the person or people addressed to adopt a particular course of action. The concept of frank speaking, or parrhesia, first appeared among the Greeks as a political virtue, (...) one exercised among free men in the public assembly for the common good. But parrhesia also was prized in the more private arena of the philosophical schools, where it was associated with the art of moral guidance. The philosophers were united in regarding frank criticism as the mark of true friendship. The consensus among them appears to have been that frank criticism was best employed with sensitivity to the situation, privately in the context of the philosophical community, and with due attention to the abilities, vulnerabilities, and needs of the person being corrected, so that he or she might heed the advice given. Modern academics likewise should strive to express their frank opinions in a way that will commend their ideas to others, speaking freely in the explicit service of persuasion for the common good. When frankness is teamed with persuasion, academic freedom finds its true purpose, and this article recommends the long-forgotten concept of parrhesia as a means to these ends. (shrink)

This essay poses the question whether it is possible, given the relationship of a subject and the method of its examination, at present as opposed to the time when Savigny worked, to talk about the same subject, and if it is not, what are the consequences for the interpretation of law. The turbulent history of Europe in the 20th century, marked by the cataclysms of world wars, genocides, expulsions and upheavals, therefore the necessity of new beginnings, jointly with other factors (...) (e.g. technological optimism) resulted not only in the ebbing of influence for religion, morality and tradition, but also in a deconstruction of law. This includes fragmentation, loss of the ability to formulate and interpret the purpose of law, as well as relativization of the traditional ordering principles of law (particularly the non-contradiction condition and contextual consistency, hierarchical structure, relative stability of law and its language). The opening of the texture of law, its deconstruction, creates a new segment of legislation, namely judicial law-making arising from the uncertainty of normative premises. (shrink)

We evaluate whether John Holland’s Echo model exemplifies his theory of complex adaptive systems. After reviewing Holland’s theory of complex adaptive systems and describing his Echo model, we describe and explain the characteristic evolutionary behavior observed in a series of Echo model runs. We conclude that Echo lacks the diversity of hierarchically organized aggregates that typify complex adaptive systems, and we explore possible explanations for this failure.

Cloth, $69.95.This book is a valuable and thoroughly-researched contribution to the study of Plato's Socratic dialogues. Its fine qualities stem in part from its cathartic motivations: for years Beversluis suppressed his ever-growing reservations concerning (...) the "standard picture" of Socrates's interaction with his various interlocutors (16). On Beversluis's account, this position naively takes Socrates's own apologia at face-value, portraying him as a self-sacrificing soul-therapist who treats his corrupt, one-dimensional interlocutors fairly, despite their many carefully drawn faults (e.g., stupidity, vanity, and violence, followed by face-saving exits). Beversluis aims to rectify this picture by retrying Socrates in a class-action suit on behalf of Socrates's interlocutors—who, he thinks, the standard account has quite unfairly maligned (while it has simultaneously ignored Socrates's "dark side"; e.g., his unscrupulous, hypocritical, and harmful tactics [esp. his conscious use of fallacy]).Beversluis's book contains a Preface, Introduction, and seventeen chapters, finishing with a very good bibliography, general index, and indexes of passages cited, names, and modern authors. Chapter 1, "The Socratic Interlocutor," examines the structure of Plato's Socratic dialogues and the role of their interlocutors. Beversluis contrasts Plato's dialogues with those produced by Augustine, Anselm, Hume, and Berkeley, arguing that a key difference between them lies in the fact that Socrates is presented as having no system to expound, championing instead the intrinsic value of philosophizing. Also, Socrates's interlocutors are drawn from a "narrow sociological group," (29) and are unprepared for their (unpleasant) encounters with Socrates (31).Chapter 2, "Elenchus and sincere assent," cogently argues that the "say what you believe" constraint on Socrates's use of the elenchus represents a consensus in need of critical reappraisal. In particular, Beversluis contends that Socrates often relies on qualified or uncomprehending assent, and that our texts do not support the idea that Socrates never argues with the soul-ignoring intention to win an argument using faulty argumentation and willful misrepresentation of the interlocutor's statements.The next fourteen chapters closely assess Socrates's encounters with Crito, Ion, Hippias, Laches and Nicias, Charmides and Critias, Euthyphro, Cephalus, Polemarchus, Thrasymachus, Hippocrates, Protagoras, Gorgias, Polus, and Callicles. One example will have to suffice here.According to Beversluis, Euthyphro's typical characterization as a pretentious, dense, father-bashing, religious zealot who "would have done well in the Nazi Youth Movement," (R. But although Beversluis rightly sees that the figure of Euthyphro is being used in a complex fashion by Plato, his account is marred in several ways. For example, although it is likely that Socrates does not himself possess complete definitions of virtue-concepts such as justice (164-169), unlike Euthyphro, Socrates can presumably provide elenchus-proof defenses of his own non-traditionalist claims. Again, while Socrates may overwhelm Euthyphro with his principles of proper definition (Eu. 5c-d, 6d-e), proceeding on uncomprehending, merely verbal agreement (169-177), Plato surely did not intend... In the UK, current policies and services for people with mental disorders, including those with intellectual disabilities (ID), presume that these men and women can, do, and should, make decisions for themselves. The new Mental Capacity Act (England and Wales) 2005 (MCA) sets this presumption into statute, and codifies how decisions relating to health and welfare should be made for those adults judged unable to make one or more such decisions autonomously. The MCA uses a procedural checklist to guide this (...) process of substitute decision-making. The personal experiences of providing direct support to seven men and women with ID living in residential care, however, showed that substitute decision-making took two forms, depending on the type of decision to be made. The first process, ‘strategic substitute decision-making’, paralleled the MCA’s legal and ethical framework, whilst the second process, ‘relational substitute decision-making’, was markedly different from these statutory procedures. In this setting, ‘relational substitute decision-making’ underpinned everyday personal and social interventions connected with residents’ daily living, and was situated within a framework of interpersonal and interdependent care relationships. The implications of these findings for residential services and the implementation of the MCA are discussed. (shrink)

Contemporary Christian witness about the death of Jesus moves in a culture already saturated with an aesthetic or intuitive ethic of the crucifixion. That aesthetic has many features acquired though Christianity’s long social dominance. This essay focuses on one aspect, authentically derived from the distinctive understanding Christian faith attributed to the crucifixion. First, I describe the Roman context, and the natural “reading” of the image of a crucified person there, as the background to considering the absence of that image in (...) early Christianity. This leads to exploration of the ways that early Christianity used a variety of typological images to weave a new frame of meaning around the crucifixion of Christ. Then, using Tom Holland’s recent historical synopsis of Christianity, I indicate how this new aesthetic of the cross lodged itself in shared cultural assumptions and perceptions. Finally, I consider the crucial American case of lynching, in which White Christian churches betrayed this distinctive meaning of the crucifixion, Black churches affirmed it, and the cultural aesthetic of crucifixion proved itself a key medium for resistance to lynching. Finally, I suggest some implications for church preaching and teaching in relation to the surrounding culture today. (shrink)

In the post-genome world of biomedical research, an increasingly common research strategy is to focus on large repositories of biological specimens. There are now several well-known efforts to compile vast collections of biological materials, reanalyze extant samples, collect new ones, and link the samples to medical records. The significant issues of law, ethics, and policy raised by these research activities usually are heightened when commercial enterprises play a leading role in accumulating and distributing the samples. Emerging companies are not only (...) compiling repositories for their own use, but some companies are positioning themselves to act as intermediaries, developing vast biobanks for sale to a wide range of other researchers. Each year individuals are required to execute millions of authorizations for the release of their health records as a condition of employment, applying for various types of insurance, and submitting claims for benefits. Generally, there are no restrictions on the scope of information released pursuant to these compelled authorizations, and the development of a nationwide system of interoperable electronic health records will increase the amount of health information released. After quantifying the extent of these disclosures, this article discusses why it (...) is important to limit disclosures of health information for nonmedical purposes as well as how it may be possible to do so. How should we understand religion, and what place should it hold, in an age in which metaphysics has come into disrepute? The metaphysical assumptions which supported traditional theologies are no longer widely accepted, but it is not clear how this 'end of metaphysics' should be understood, nor what implications it ought to have for our understanding of religion. At the same time there is renewed interest in the sacred and the divine in disciplines as varied as philosophy, psychology, literature, history, (...) anthropology, and cultural studies. DNA identification methods are such an established part of our law enforcement and criminal justice systems it is hard to believe that the technologies were developed as recently as the mid-1980s, and that the databases of law enforcement profiles were established in the 1990s. Although the first databases were limited to the DNA profiles of convicted rapists and murderers, the success of these databases in solving violent crimes provided the impetus for Congress and state legislatures to expand the scope of (...) the databases with little critical examination of each expansion's value to law enforcement or cost to privacy and civil liberties.We are now entering a new stage of DNA forensics, in which successive database expansions over the last decade have raised the possibility of creating a population-wide repository. In addition, new applications of DNA profiling, including familial and low stringency searches, have been added to DNA dragnets, the use of medical samples for forensic analysis, and other measures to create a series of crucial, yet largely unexplored, second-generation legal and policy issues. Calling for an expanded framework of EuroAmerican science's methodology whose perspective acknowledges both quantitative/etic and qualitative/emic orientations is the broad focus of this article. More specifically this article argues that our understanding of shamanic and/or other related states of consciousness has been greatly enhanced through ethnographic methods, yet in their present form these methods fail to provide the means to fully comprehend these states. They fail, or are limited, because this approach is only a “cognitive interpretation” or “metanarrative” of the (...) actual experience and not the experience itself. Consequently this perspective is also limited because the researcher continues to assess his or her data through the lens of their symbolic constructs, thereby preventing them from truly experiencing shamanic and psi/spirit approaches to knowing since the data collection process does not “in and of itself” affect the observer. We, therefore, need expanded ethnographic methods that include within their approaches an understanding of methods and techniques to experientially encounter these states of consciousness—and become transformed by them. Our becoming transformed and then recollecting our ethnoautobiographical experiences is the means toward a new kind of science and its methods of inquiry that this article seeks to encourage. The Rationality Principle says that people act adequately to their situation, but does not specify how they must act in order to do so. Situational Analysis uses the Rationality Principle, together with a model of the social situation, to explain actions in the past. Unlike Rational Choice Theory, Situational Analysis does not try to predict or influence actions in the future. Popper regarded the Rationality Principle as false, but thought that we should use it nonetheless. This poses a problem for (...) understanding his views about conjecture and refutation. The dynamical patterns in mental phenomena have a characteristic suppleness&emdash;a looseness or softness that persistently resists precise formulation&emdash;which apparently underlies the frame problem of artificial intelligence. This suppleness also undermines contemporary philosophical functionalist attempts to define mental capacities. Living systems display an analogous form of supple dynamics. However, the supple dynamics of living systems have been captured in recent artificial life models, due to the emergent architecture of those models. This suggests that analogous emergent models might be able to explain (...) supple dynamics of mental phenomena. There is a long history of cryptographic hash functions, i.e. functions mapping variable-length strings to fixed-length strings, and such functions are also expected to enjoy certain security properties. Hash functions can be effected via modular arithmetic, permutation-based schemes, chaotic mixing, and so on. Herein we introduce the notion of an artificial-life (ALife) hash function (ALHF), whereby the requisite mixing action of a good hash function is accomplished via ALife rules that give rise to complex evolution of a given system. The HIPAA Privacy Rule is notoriously weak because of its incomplete coverage, numerous exclusions and exemptions, and limited rights for individuals. The three areas in which it provides the most protection are fundraising, marketing, and research. Provisions of the 21st Century Cures Act, pending in Congress, and the Notice of Proposed Rulemaking to amend the federal research regulations, awaiting final regulatory action, would weaken the privacy protections for research. New developments in genetics could affect a variety of real property rights. Mortgage lenders, mortgage insurers, real estate sellers, senior living centers, retirement communities, or other parties in residential real estate transactions begin requiring predictive genetic information as part of the application process. One likely use would be by retirement communities to learn an individual's genetic risk for Alzheimer's disease. The federal Fair Housing Act prohibits discrimination based on disability, but it is not clear that it would apply to genetic (...) risk assessments. Abstract:Moral imagination is a reasoning process thought to counter the organizational factors that corrupt ethical judgment. We describe the psychology of moral imagination as composed of the four decision processes identified by Rest (1986), i.e., moral sensitivity, moral judgment, moral intention, and moral behavior. We examine each process in depth, distilling extant psychological research and indicating organizational implications. Malevolence and cruelty are commonly attributed to a failure of moral reasoning or a lack of moral imagination. We present the contrasting viewpoint – immorality as an active, creative, or resourceful act. More specifically, we develop the concept of "immoral imagination" (Jacobs, 1991) and explore how it can enter into Rest's (1986) four processes of decision making: sensitivity, judgment, intention, and implementation. The literature on revenge and workplace deviance illustrates these processes.
